PLEASE READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY

This is an agreement between you and the KIAA

As a condition of joining the KIAA, you agree to the following Terms and Conditions:

1. Identify the number of karaoke music libraries you are using regardless of format (i.e. CD+G, PC, CAVS, Super CD+G, etc.)

2. Register all of your karaoke music libraries by emailing your songbook or song list in an electronic format. Please note that your application for membership cannot be processed until we receive copies of your songbooks or song lists.

3. All karaoke music libraries must be brought into full compliance within 90 days of your application submission date. If your library contains karaoke music that you have not legitimately purchased, or you no longer own the originals regardless as to whether they were lost, stolen or 1broken, then you must contact the karaoke labels whose music you have in your libraries and make arrangements with each of the labels to bring your karaoke music libraries into full compliance.

If your library contains karaoke content from one or more karaoke labels that no longer exists, and you never purchased or no longer own the original copy, then you must either purchase legitimate copies of these products or remove them from your library. In some cases these products might only be available as used or refurbished discs.

4. Agree to a voluntary audit and/or field audit of your karaoke music libraries. A representative of the KIAA may check your karaoke music libraries for compliance. The KIAA may at its discretion, employ the use of a Certified Public Accountant in your area to perform the audit based on KIAA criteria. All audits will be at the expense of the KIAA unless it can be determined beyond reasonable doubt that you have deliberately and willfully provided the KIAA with falsified documents in describing your music libraries, in which case you will be responsible for all audit expenses.

5. Agree to the KIAA redress policy for using unauthorized karaoke music content.
a. If it has been determined that your karaoke music libraries have not been brought into compliance within the 90 days of your application submission date, then you will be sent a 30 day warning letter demanding that you do so.

b. At the end of that 30 day period, if you have not complied with the demand then you will be fined $1,000, and given 15 days to bring the karaoke library(s) into compliance.

c. If at the end of the 15 days you still have not met the KIAA demand, then:

• Your KIAA membership will be terminated.
• Your actions or lack thereof will be deemed to be an act of infringement.
• Your name and contact information will be forwarded to the karaoke labels whose products you have infringed upon for possible prosecution. In the case where your infringing content is made up entirely of karaoke labels no longer in existence, a penalty of $10,000 will levied against you.

6. Report any and all illegal activity or suspected illegal activity involving karaoke shows or karaoke products that have been brought to your attention.

7. Place the information found at this webpage in your songbook. This document outlines the KIAA guidelines and explains where and how to report suspected violations.

8. Help spread the message of the KIAA by educating your venues on piracy issues by discussing with them the problems of karaoke piracy and how it impacts the karaoke industry.
